This page will describe management of our web site as regards processing the personal data of users that visit us.

Privacy Policy for the processing of personal data pursuant to art. 13, EU Regulation 2016/679

 

Dear User,

As Data Controller, Bertazzoni S.p.a. (hereinafter “Bertazzoni S.p.a.” or the “Data Controller”) with registered offices at 8, Via Palazzina, Guastalla (RE) VAT no. 00140710351, considers privacy and the protection of personal data among the main aims of its business activities. This document has been prepared pursuant to art. 13 of EU Regulation 2016/679 (hereinafter, the “Regulation” or “GDPR”) to introduce you to our privacy policy; please read this Privacy Policy carefully before providing any personal data to the Data Controller, because it contains important information on the protection of your personal data. This Privacy Policy is applied to the websites bertazzoni.com and lagermania.com (hereinafter jointly referred to also as the “Site”) and is an integral part of the services offered through the Site.

The processing of your personal data will be based on the principles of fairness, lawfulness, transparency, limitation of purpose and conservation, minimization and accuracy, integrity and confidentiality, as well as the principle of accountability pursuant to art. 5 of the Regulation. Your personal data will therefore be processed in accordance with the legal provisions of the Regulation and the confidentiality obligations set forth therein.

 

Personal data processing means any operation or series of operations performed on sets of personal data, whether or not by automated means, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction;

1. Data Controller

The Data Controller is Bertazzoni S.p.a., as identified above.

 

2. The Personal Data we process

After you browse the Site, Bertazzoni S.p.a. will process certain personal data, which may consist of an identifier such as a name, identification number, on-line identifier or one or more characteristic elements of your physical, physiological, psychological, economic, cultural or social identity, able to identify you as the Data Subject (hereinafter, simply the “Personal Data”). The Personal Data we process is as follows:

 

a. Browsing data

In normal operation, the computer systems and software procedures used to operate the Site acquire certain Personal Data whose transmission is implicit in the use of Internet communication protocols. This is information not collected for association with identified data subjects, but information which, by its very nature could, through processing and association with data held by third parties, permit the identification of users. This category of data includes IP addresses or domain names of the computers used by users connecting to the Site, the URI (Uniform Resource Identifier) addresses of the requested resources, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response given by the server (successful, error, etc.) and other parameters relating to the user’s operating system and IT environment. This data is used in the form of server side “logs” for the sole purpose of obtaining information on the use of the Site and to check its correct operation, to permit - given the architecture of the systems used - the correct provision of services, security and to ascertain liability in the event of possible cyber crime against the Site or third parties; this data is processed in accordance with the GDPR and kept for the time strictly necessary to achieve the aforementioned purpose.

 

b. Special categories of Personal Data

When using the Work with us section, you may be required to provide Personal Data falling within the special categories of personal data as defined in art. 9 of the Regulation, quoted verbatim as “[...] data suitable for revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, as well as processing genetic data, biometric data intended to uniquely identify a natural person, data relating to the health or sexual life or sexual orientation of the person”. c. Data provided voluntarily by the user

The Site allows users to provide personal information voluntarily, for example, through registration on contact forms, requests for services or information, and the facultative, explicit and voluntary transmission of e-mail to the addresses indicated on the Site, as well as by completing Customer satisfaction questionnaires, etc. The Privacy Policy therefore applies to the processing of any Personal Data provided voluntarily through the Site.

 

d. Third-party data provided by the Site user

When using certain services of the Site, Bertazzoni S.p.a. may also process some third party Personal Data that you have provided. This could be the case, for example, when a user of the Site (whether or not registered on the Site) provides the e-mail address of a friend/relative/acquaintance/colleague to recommend one or more Bertazzoni S.p.a. products. In such cases, you, as a user of the Site who provides the Personal Data of a third party (your friend, acquaintance, relative, etc.), act as an independent data controller, and therefore assume all relevant legal obligations and responsibilities. As such, you will be required to fully indemnify Bertazzoni S.p.a. against any complaint, claim or demand for compensation for damages caused to any third party whose Personal Data has been processed through your use of the Site in violation of the applicable data protection regulations. In the case described, in the e-mail recommending one of our products to the third party, Bertazzoni S.p.a. will provide the third party with your name and e-mail address, this being Personal Data you have provided to Bertazzoni S.p.a., in order to adequately inform the third party of the reason for the e-mail and the source that provided their Personal Data. We therefore recommend that you provide correct and truthful Personal Data (whether yours or of third parties) and never use the Site and the services offered therein for any unlawful purpose.  In any case, should you provide or otherwise process third party Personal Data in your use of the Site, you must guarantee - assuming all related responsibility - that such processing has a suitable legal basis pursuant to art. 6 of the Regulation on the lawfulness of Processing.

It is understood that the third-party Data Subject may request information on the source of the Personal Data and request its erasure at any time, by writing to the contacts indicated in section 8. Rights of Data Subjects below.

 

e. My Bertazzoni and My Project sections

In the My Bertazzoni section (bertazzoni.com/my-bertazzoni) we will collect your name and surname, e-mail address and password to allow you to register on our Site. If you wish, you can activate the guarantee by registering the product you purchased in the Product Registration section (bertazzoni.com/my-bertazzoni/my-bertazzoni-my-product), entering the product technical code and serial number, as well as your address, the date of purchase and proof of purchase. In the My Project Section (bertazzoni.com/altra/myprojects) you can save your favourite products and share them via e-mail with your other contacts; regarding this processing, we recommend you carefully read section 2.d Third party data provided by the Site user above.

 

f. Cookies

Definitions, characteristics and application of the legislation

 

Cookies are small text files that sites you visit send and record on your computer or mobile device, which are re-transmitted to the same sites on your next visit. Through the use of cookies, sites remember your actions and preferences (such as, for example, login data, the chosen language, font size, other display settings, etc.) to avoid having to enter them again when you return to the site or browse its pages. Cookies are used for mainly for authentication purposes, session monitoring and to save information on the activities of users visiting the site, and may also contain a unique identification code able to track of the activities of users browsing the site itself, for statistical or advertising purposes. While browsing a site, you may also receive cookies from sites or web servers different to the one you are currently at (known as “third-party” cookies). Some operations would be impossible without the use of cookies, which in certain cases are technically necessary for the site to operate.

There are various types of cookies with different characteristics and functions, which can remain on your computer for different periods of time: session cookies, for example, are automatically deleted when the browser is closed; persistent cookies, on the other hand, remain on your device for a predetermined length of time.

According to the current Italian legislation, the use of cookies does not always require your consent. In particular, “technical cookies”, i.e. those used for the sole purpose of transmitting a communication over an electronic communications network, or to the extent strictly necessary to provide a service explicitly requested by the user, do not require this consent. In short, these cookies are either essential for the operation of the site, or necessary for the activities requested by the user.

In the provision of the Italian Data Protection Authority (see Identification of simplified procedures for privacy policies and the acquisition of consent for the use of cookies dated 8 May 2014 and subsequent clarifications, hereinafter simply the “Provision”), the technical cookies not requiring express consent for their use include:

 

  • “analytics cookies” when used directly by the site operator to collect information, in aggregate form, on the number of users and how they visit the site,
  • browsing or session cookies (for authentication),
  • functionality cookies, which allow users to customize the website according to a series of selected criteria (for example, language preferences, products selected for purchase), to improve the service provided.

 

On the other hand, “profiling cookies”, i.e. those aimed at creating user profiles and used to send advertising messages corresponding to the preferences expressed by the users while browsing the net, require the user’s prior consent.

 

Types of cookies used by the Site and optional enable/disable

 

Except for third party cookies, for which you should refer directly to the corresponding disable/enable procedures indicated in the links, the Site uses the following cookies, which can be disabled:

 

  • Technical browsing or session cookies strictly necessary for the operation of the Site or to permit use of the requested content and services.
  • Technical analytics cookies, for the analysis of Site usage by users. These cookies do not collect information on the user's identity or any personal data. The information is processed in aggregate and anonymous form.
  • Functionality cookies, i.e. used to enable specific functions of the Site and a series of selected criteria (for example, the language) to improve the service provided.

 

WARNING: if you disable technical and/or functionality cookies, the Site may not be available, or some services or functions of the Site may not work properly, and you will have to modify or enter certain information or preferences manually each time you visit the site.

 

  • Third-party cookies, i.e. cookies from websites or web servers other than the Bertazzoni S.p.a. Site, used for the purposes of said third parties, including profiling cookies. Note that these third parties, listed below with links to the relevant privacy policies, are usually independent data controllers of the data collected through the cookies they serve; you should therefore refer to their personal data processing policies, information and consent forms (cookie enable/disable options), as specified in the aforementioned Provision. On its part, Bertazzoni S.p.a. makes all possible efforts to track the use of cookies on its Site. For the sake of transparency, in the table available at the link provided below we provide regular updates on the cookies used and their purposes. We also provide links to the privacy policies of any third parties sending cookies through our Site. As previously mentioned, such third parties are responsible for providing adequate information and obtaining your consent to the use of cookies, as required by the Provision. This responsibility refers not only to the cookies sent directly by third parties, but also to any further cookies sent through our Site through the use of services used by the third parties themselves. Given that these cookies are in effect sent by service providers of the aforementioned third parties, Bertazzoni S.p.a. has no direct control over their use and no knowledge of their characteristics or purpose.

3. Purpose of processing

Your Personal Data will be processed, if necessary with your consent, where applicable for the following purposes:

  1. to permit provision of the requested services (e.g: to respond to a request for contact, information or materials; permit activation of the “All inclusive” guarantee; register on the site through the My Bertazzoni area; register products or subscribe to My Project; request assistance, including customer assistance services, recommend products to your contacts, etc.), and permit browsing of the Site (“Provision of services”);
  2. to conduct marketing activities, such as surveys and market research, and send information and promotional material on the activities, products and services of Bertazzoni S.p.a., including our newsletter. This content may also regard the IaGermania brand. In accordance with the Italian Data Protection Authority “Guidelines in the matter of promotional activities and the fight against spam - 4 July 2013 [2542348]”, if you consent to receiving information on promotional activities, including market research, we inform you that these activities may be conducted, as required by current regulations, by paper mail, telephone contacts through call centers (“traditional methods”), as well as e-mail, text messages and social networks (“automated methods”). We likewise inform you that you can revoke the consent previously given by traditional or automated methods at any time, by writing informally to the Data Controller at privacy@bertazzoni.com, or through the link at the bottom of our commercial e-mails, without prejudice to the lawful basis for processing based on the consent given prior to revocation (“Marketing”);
  3. to create user profiles, analysing the preferences, habits, interests and choices expressed through the use of the Site and its services and, where appropriate, use profiling cookies to send you commercial material, communications and personalized promotions on the services offered by Bertazzoni S.p.a. (“Profiling”). In specific terms, Bertazzoni S.p.a. will use the Personal Data to create “clusters” (homogeneous groups consisting of profiles with a certain level of correlation) based on user preferences and on-line behaviour, for the purpose of sending personalized, targeted commercial communications, in line with the tastes of the Site’s users.

If for any reason you wish to oppose and withdraw your consent to the processing of your Personal Data for profiling purposes, you can do so at any time by writing to privacy@bertazzoni.com. Your withdrawal of consent will not affect the lawfulness of processing based on the consent previously given;

  1. to send commercial communications and conduct direct marketing campaigns via e-mail for similar products and services to the ones you purchase - including the La Germania brand - unless you explicitly refuse to receive such communications when requesting a service or purchasing a product, or at a later date by writing to privacy@bertazzoni.com, using the link found at the bottom of each soft opt-in email;
  2. to fulfil any obligations under applicable laws, regulations or community legislation, or comply with requests by authorities (“Compliance”).

4. Lawful basis and mandatory or optional nature of the provision of data

Bertazzoni applies the following lawful bases for processing your Personal Data for the purposes indicated in Section 3 above:

- Provision of services: the processing of your Personal Data for this purpose (Sec. 3.a.) is necessary for the provision of the Services and to meet your requests, therefore, for the performance of the contract to which you are party. The lawful basis of this treatment is art. 6(1)(b) of the Regulation (“[...] processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract”). You can choose not to provide your Personal Data for this purpose, but if you do not complete  the fields marked with an asterisk (*) it will not be possible to provide the Services through the Site or respond to your requests. Please remember that regarding the processing of third party data provided by you through the Site (see section 2.d. Third-party data provided by the Site user), you effectively guarantee that you have a suitable legal basis for communicating the data to Bertazzoni S.p.a., which legitimizes its subsequent processing;

- Marketing: processing for Marketing purposes is based on your specific consent in accordance with art. 6(1)(a) of the Regulation (“[...] the data subject has given consent to the processing of his or her personal data for one or more specific purposes”).

The provision of your Personal Data for this purpose is therefore entirely optional and does not affect use of the Services. Note also that if you have otherwise provided or denied Bertazzoni S.p.a. such consent, the chronologically most recent action will be taken as the reference. If you wish to withdraw your consent, you can do so at any time by writing to privacy@bertazzoni.com or using the link at the bottom of our marketing e-mails;

- Profiling: processing for Profiling purposes is based on your specific consent in accordance with art.. 6(1)(a) of the Regulation (“[...] the data subject has given consent to the processing of his or her personal data for one or more specific purposes”).

The provision of your Personal Data for this purpose is therefore entirely optional and does not affect use of the Services. Note also that if you have otherwise provided or denied Bertazzoni S.p.a. such consent, the chronologically most recent action will be taken as the reference. If you wish to withdraw your consent, you can do so at any time by writing to privacy@bertazzoni.com;

- Soft opt-in: pursuant to the current personal data protection legislation, the processing of your data for these purposes is legitimate and does not require your consent. You can oppose the processing of your Personal Data for this purpose when requesting products and services, or later by writing to the Data Controller at privacy@bertazzoni.com, or using the link at the bottom of these e-mails;

- Compliance: the processing of your Personal Data for this purpose is based on art. 6(1)(c) of the Regulation (“[…] processing is necessary for compliance with a legal obligation to which the controller is subject”).

5. Recipients of Personal Data

For the purposes defined in Section 3 above, your Personal Data may be shared with:

a. persons authorized by us, such as Bertazzoni employees, for conducting activities strictly related to the provision of the services, who adhere to adequate confidentiality and non-disclosure agreements;

b. subjects who typically act as data processors, namely: i) people, companies or professional firms that provide administrative and legal services and assistance to Bertazzoni S.p.a. on the provision of services; ii) subjects with whom it is necessary to interact for the provision of services (for example hosting and call center service providers) or; iii) subjects delegated to carry out technical maintenance activities (including maintenance on network equipment and electronic communications networks;

c. law enforcement agencies, bodies or other authorities to whom your personal data must be sent by law, court order or other provisions of the authorities, or if necessary for defence in legal proceedings;

d. companies belonging to the Bertazzoni S.p.a. Group, strictly for administrative-contractual purposes connected with activities of an organizational, administrative, financial and accounting nature.

6. Transfer of Personal Data

Your Personal Data may be shared with recipients who could be located outside the European Economic Area. Bertazzoni S.p.a. ensures that the processing of your Personal Data by said recipients is conducted in compliance with the Regulations. In effect, such transfers may be based on an adequacy decision, on the Standard Contractual Clauses approved by the European Commission or on another suitable legal basis. You can get more information from the Data Controller by writing to the addresses indicated in the “Contacts” section of this privacy policy.

7. Storage of Personal Data

Personal Data processed for the purpose of providing services will be kept for the time strictly necessary to achieve that purpose. In any case, given that such processing is conducted for the provision of services, Bertazzoni S.p.a. will process and store your Personal Data for the period allowed by Italian law for the protection of its interests (Article 2946 et seq. of the Italian civil code).

Personal Data processed for Marketing and Profiling purposes will be processed until you withdraw your consent.

Personal Data processed for the Soft Opt-in purposes will be processed until you oppose such processing.

Personal Data processed for Compliance purposes will be kept for the period required by the specific obligation or applicable law.

More information on Personal Data storage times and the criteria applied to determine this period can be obtained from the Data Controller.

8. Rights of Data subjects

Pursuant to Art 15 et seq. of the Regulation, you have the right to ask Bertazzoni S.p.a. for access to your Personal Data to correct, delete or oppose its Processing pursuant to art. 21 of the Regulation, and the right to request limitations to the processing of your data in the cases provided for under art. 18 of the Regulation, as well as to obtain the Personal Data concerning you in a commonly used, structured format readable by an automatic device, in the cases provided for under art. 20 of the Regulation.

You can withdraw your consent to the use of Profiling cookies using your browser functions, control panel or by consulting the privacy policies of the third parties serving cookies through the Site (see section 2.f. of this Privacy Policy).

In all cases you can always lodge a compliant with the competent Data Protection Authority (Garante per la Protezione dei Dati Personali), pursuant to art. 77 of the Regulation, if you consider the processing of your Personal Data to be in violation of the legislation in force.

9. Modifications

The Data Controller may modify or simply update the Privacy Policy for its Websites, whether part or entirely, as a result of changes to the rules and regulations governing such matters and protecting your rights. Bertazzoni S.p.a. will inform you of any changes or updates to the Privacy Policy on the home page of the Site. We recommend that you consult this section regularly to view the most recently updated version of the Privacy Policy, to be fully aware of the information we collect and the use we make of it.
